A Texas HOA Towed the Car of a Resident With a Disability: ‘The Vehicle Was Taken Under False Pretenses’

There are thousands of stories where residents have to face a nightmare HOA for its exaggerated rules and demands. Of course, some other neighborhood associations are not so bad and are even helpful. However, this HOA in Texas, from a post on Reddit, is one of the worst after having a car towed that belongs to a resident with a disability. It looks like just a case of a Karen from an HOA hating that the resident’s car ruined the neighborhood’s aesthetic because there was no real reason.

Redditor Relevant-Pea-8524 sought advice from r/legaladvice after someone impounded their car. This resident says that on April 9, someone towed their car from their condo’s parking lot in Texas, after the HOA asked for it because “the car was inoperable,” but OP doesn’t drive much because they have a disability. OP says that they don’t get out of the home much because they suffer from Chronic Fatigue Syndrome, but still drive the car. This resident also has all the permits to use their vehicle and signs to show they can use the parking space. Relevant-Pea-8524 pointed out that they drove quite a bit in the previous month and did so a week before the towing. The worst thing is that OP does not have enough money to recover their car from the impound. That’s why the users didn’t waste time giving their advice, like:

You likely need to start with a demand letter from a lawyer, but you need to get it out of the impound as soon as possible as you’ll have a duty to limit fees as well.
Once you have it out, if they don’t respond to the demand letter, you either take them to small claims or hire a lawyer to sue them. You’ll need proof the vehicle was taken under false pretenses (such as recording it starting while in the impound)

This was a cruel and calculated measure, considering that OP has medical problems that prevent them from leaving the house for a long time. Or maybe the HOA doesn’t communicate with the residents of the neighborhood, whom they “care for.” Still, the HOA should have contacted OP first to see why the car stayed in the parking lot for so long instead of just acting without any prior conversation. Hopefully, OP can get their vehicle back soon and make the HOA pay.
