A Texas man says he found himself in a frustrating situation after discovering that the property he bought was actually part of an HOA, despite specifically looking for a home without one. The situation became even more complicated when he began receiving fines for allegedly violating HOA rules. He now says he is questioning how the HOA was missed during the home-buying process and what he can do about it.

The story was shared by Nick, who posts on TikTok under the username iamprovolone. His video explaining the situation received several million views, drawing strong reactions from viewers who sympathized with him and questioned how a property could allegedly be sold without the HOA being disclosed to the buyer.

Nick explained that he does disaster relief work and wanted a property where he could potentially turn the home into an Airbnb when he was away for months at a time. Because of that, the Texas man specifically wanted a house that was not part of an HOA.

According to Nick, he discovered a few months after purchasing the property that it was subject to an HOA after receiving letters from the organization. When he contacted the HOA, he says they were shocked that the property had even been sold.

Nick then contacted his real estate agent, who directed him to the title company. After requesting the relevant documents, the Texas man says he discovered that the HOA was citing him for rule violations and charging him fines.

One of the alleged violations involved a travel trailer being kept on the property. Nick says he did not actually have a travel trailer there, but did have an empty utility trailer. Despite that distinction, he says the HOA continued fining him every month. Nick also claimed that the previous sellers had left the country, making the situation even more difficult to resolve.

The main question is whether the property was legally subject to the HOA and whether that information should have been disclosed during the sale. That could depend on the purchase documents, title records, recorded property restrictions and applicable Texas law.

Texas Man’s HOA Dispute Sparks Online Outrage

Commenters overwhelmingly sided with Nick, with many urging him to consult a lawyer before paying the fines or taking any action with the HOA. Some speculated that the previous owner may not have been part of the HOA and that the association was now trying to force the Texas man into it after the property was sold. 

Others focused on the alleged failure to disclose the HOA during the sale, suggesting that the seller, realtor, or title company could potentially be responsible. Many viewers also argued that Nick should review his purchase documents and determine whether the HOA was legally included in the property before accepting any of its fines.

Several commenters suggested investigating the seller, realtor, title company and closing agents if the HOA was left out of the sale documents. Others warned Nick not to pay the fines before getting legal advice. The situation also brought out the usual anti-HOA sentiment, with one commenter writing, “HOA is such a wild concept… USA is really weird.”

For Nick, what was supposed to be a home in Texas without an HOA has apparently turned into exactly the kind of property headache he was trying to avoid.
