In many cases, HOAs are a type of nuisance that only causes problems for homeowners and renters. We won’t deny that some of these associations do help and take care of neighborhoods. However, a Texas homeowner is experiencing significant issues with their HOA, which demands that they fix their yard or face a fine. In addition, the homeowner has only 10 days to make the necessary repairs before the issue gets worse.
Redditor Adeptness_Same shared their predicament on r/HOA. According to OP, their HOA in Texas requires them to fix a corner of their yard that has no grass, or they will face a fine. OP has only 10 days to comply with their HOA’s demands. Still, they claim the area is just dirt because the adjacent sidewalk has sunk half an inch. For that reason, OP believes that the HOA is responsible for maintaining the sidewalk. They believe that due to the HOA’s negligence, OP’s yard is in poor condition; therefore, the HOA should fix it. Yet, this depends on the county and the state.
‘Probably not and you’re gonna need to drag up a plot plan of your house. In my municipality (NOT Texas), developments adjacent to public roads must have sidewalks, and the sidewalks are owned by the county. It’s “probably” the same thing here, so the first think you need to determine is if your HOA owns the roads or if they do not. This should be easy to determine (if your community is gated, then they own the roads; but a property ownership map should also show you)‘ said Waltzer64.
However, many comments suggest that the sidewalk collapsed because the garden lacks grass. And the grass helps prevent the soil from washing away. In addition, many accuse OP of being negligent and causing the whole problem. To make matters worse, these same users say that the problem is easy to fix. So OP should stop complaining and better get to work.
‘So your sidewalk sinking half an inch caused all your grass to die? Seriously? Your grass died because of neglect and the dirt is now washing into the sidewalk because you have no grass there. Plant some seed and water it. It’s an easy fix‘ commented DarkRider23.
This seems like the OP is making the problem much bigger. Fixing their garden will be much cheaper than investigating the matter and waiting for the fine.
