Ever since its inception, AI has been a controversial topic. On the one hand, people claim it’s been useful to make some mundane tasks a bit easier. On the other hand, it has created some questionable things that have affected our society in many ways. One recent case happened in Arizona, where a judge vacated the sentence of a convicted criminal after the victim’s family showed an AI-generated video of the deceased person forgiving the one who caused their death.
The shocking news, which has already been covered in several outlets, mentions the case of Gabriel Paul Horcasitas. Back in 2021, he was convicted of killing someone during a road-rage incident in Chandler, Arizona. Last year, he got a prison sentence of around 10 years. However, something happened during the hearing.
The family of the victim showed an AI-generated video of the deceased person, forgiving Horcasitas. The AI-generated victim even said how he and Horcasitas could’ve been friends in a different life. With that in mind, the judge vacated Horcasitas’ sentence, and he’s now waiting for another hearing.
What makes the whole situation so shocking is that, according to the Fashion Times, the judge praised the video, saying it was “genuine.”
With the judge vacating the sentence, people couldn’t believe that the reason for this was the AI-generated video, as many have claimed this borders on the dystopian and also questions the judge’s criteria when it comes to such a delicate case as this.

As expected, many people felt angry after learning that AI could affect a criminal case, and in ways that no one would expect. Yet, the majority are criticizing the judge, as they believe they aren’t fit to be in front of a court and make such important decisions.

Others blamed the victim’s sister, who was the one who brought the video up. One would expect the defense to do this, but not the victim’s family.
“This is absolutely disgusting of the sister.“
Ultimately, there’s still going to be another hearing, so we’ll have to wait and see if Horcasitas goes free or he’ll be sentenced again. Regardless of what may happen, people still think the judge made a poor call and that AI should not have a place in a court of law.
