Colorado Landlord Gets Offended Because Their Soon-To-Be Tenant Did a Radon Test on the Property: ‘He Doesn’t Know Disrespect … Yet’

You are taking a big risk if you stay in that place

Landlords and property managers have specific duties to ensure the safety of those who enter a place. Colorado, for example, is a state with high levels of Radon, and its laws require that this information be disclosed. It is ridiculous that a landlord in Denver, Colorado, felt offended when a prospective tenant conducted a Radon test on the property without permission. Usually, when someone complains about something like this, it’s because they are trying to hide something.

Landlord thinks it’s ’unbelievably disrespectful’ I did a radon test in a garden unit? Advice or thoughts?

Redditor Critical-Reading9157 sought advice from other users on r/ApartmentLiving. This is because OP was about to move. Still, according to Colorado law, “the landlord must legally disclose any prior inspections, tests, or abatements before a tenant signs a lease,” such as a radon test. However, the landlord did not share any of these documents. So, OP opted to do some mail-in Radon tests and then shared the results with the landlord. Sadly, the landlord responded by saying he was offended that the OP had done the tests. This issue primarily stems from the landlord’s supposed Radon test in 2023, which showed levels that were “fine.” However, the results of OP’s tests showed a health risk.

“I don’t want tenants that behave as you do,” you mean tenants who make sure you’re doing your job correctly and not putting their health at risk?” commented Aurora-Auror.

This demonstrates the landlord’s gross irresponsibility and deliberate negligence. In Colorado, property owners must be aware of the risks associated with their property. Although this is not the first or only case where someone seeks to take advantage of the situation, it has led many other users to wonder what else this landlord might be hiding and how much he might be putting his tenants at risk for financial gain.

‘Quick test pipes for lead, water for contamination, paint for lead, ceiling for asbestos, heating oil tank for leaks … He doesn’t know disrespect … yet,’ said gcalig.

Other users suggested numerous additional tests and checks that the landlord should conduct, as well as that the OP should provide more thorough details. This process begins with inspecting the electrical wiring and checking every corner for mold, ensuring that the door handles function correctly. However, OP added that they didn’t know whether to give up on that apartment simply because of its good location. However, perhaps the landlord will not want to proceed with the deal with OP. Also, moving into that place could pose a significant risk for OP.
