A Florida woman confrontation with a grocery store employee is stirring up another debate over service dogs after the worker allegedly refused to check out her groceries unless her dog was put on a leash. Plenty of viewers insisted the employee was right because “ALL DOGS SHOULD BE ON A LEASH.” There’s just one problem with that argument. Federal ADA rules specifically allow some service dogs to work without one.

After 15 minutes of this, I eventually walked away and told her to call the police if she wanted. Thankfully all the other employees were apologetic. Yes, my feet are sandy from the beach. No, I don’t have the time or energy to file a formal complaint. The general manager who I called a few days later said he would have his staff take an online course to learn more about service animals. I left with flowers and chocolate given to me by other staff. Sharing to inform others. Fake service animals ruin it for us out here. For yall who don’t have 20 seconds to go to the ADA website “animals must be harnessed, leashed, or tethered, UNLESS the individual’s disability prevents using these devices or these devices interfere with the service animal’s safe, effective performance of tasks. TikTok creator Elyssa Male who goes by the username @emalemetheslpsaid her service dog’s trained tasks require it to work off leash. During the confrontation, Male tells the employee, “You can’t say that you’re not gonna check out my groceries because my dog is not on leash.”

After a manager became involved, the employee eventually acknowledged she may have gotten the rule wrong. “I do think I was wrong, and I am sorry,” she told Male. However, the employee continued offering to complete Male’s shopping while she waited outside.

In the caption, Male says the confrontation lasted about 15 minutes before she eventually walked away.

Federal ADA guidance largely supports Male’s argument about the leash requirement. Service dogs generally must be harnessed, leashed or tethered, but there’s an exception when doing so would interfere with the dog’s trained work or the handler’s disability prevents their use. The handler must still maintain control of the animal through voice commands, signals or another effective method.

Not everyone believed the employee handled the situation poorly. Some argued the worker was simply trying to balance the rights of everyone inside the store.”What about the shoppers that have a debilitating fear of dogs? When do their rights or disabilities matter?” one commenter asked.

Others argued every dog, regardless of training, should remain leashed in public.”ALL DOGS SHOULD BE ON A LEASH. Idk why dogs owners have such an issue with keeping there ANIMALS on a leash,” one viewer wrote.

Supporters of the creator pushed back, arguing the employee misunderstood the ADA and wrongly prevented her from shopping.”Making you stand outside and her do your grocery shopping is not an accommodation. That is still discrimination,” one commenter wrote.

Another added, “They legally cannot deny you entry to a service animal.”One viewer compared the situation to another medical aid, writing, “‘magine trying to take away someone’s wheelchair cause you don’t like it in the aisle, service dogs are not the same as pets they are legally medical “equipment.”

Viewers can argue over whether they believe every dog in a grocery store should be leashed, but federal rules aren’t quite that simple. The ADA specifically recognizes circumstances in which a service dog can work without a leash, provided the animal remains under the handler’s control. Whether Male’s dog met those requirements can’t be independently determined from the TikTok alone, but “all dogs must be leashed” isn’t what the federal rule actually says.
