During Trump’s presidency, U.S. Immigration and Customs Enforcement agents have adopted increasingly forceful and confrontational tactics. Their latest move was the arrest of Wilson Martell-Lebron—one in a growing list of individuals abruptly detained by ICE. This time, however, their actions were met with resistance. A Boston Municipal Court judge in Massachusetts found the arrest unacceptable and intervened. Martell-Lebron was in the middle of a trial when ICE agent Brian Sullivan apprehended him outside the courthouse.
On Monday, Judge Mark Summerville held ICE agent Brian Sullivan in contempt of court for violating Wilson Martell-Lebron’s right to due process. “It’s a case of violating a defendant’s right to be present at trial and confront witnesses against him,” Summerville said. Following the incident, the Boston judge dropped the case against Martell-Lebron, who had been accused of lying on his driver’s license application.
The Boston judge isn’t the only one who took issue with the ICE agent’s actions. One of Martell-Lebron’s attorneys, Ryan Sullivan, also condemned the arrest. “There is no greater injustice in my mind than the government arresting someone—without identifying themselves—and preventing them from exercising their constitutionally guaranteed right to a jury trial,” he said.
ICE has stayed silent on the controversy, but U.S. Attorney Leah B. Foley has taken legal action to overturn the contempt ruling against agent Brian Sullivan. In her motion, Foley argued that the state court lacked jurisdiction to issue the order, invoking the Supremacy Clause of the U.S. Constitution, which she said protects federal agents from being penalized by state authorities while performing their official duties.
Thanks to their growing infamy, many people cheered after hearing what happened to the ICE agent. With so many people being illegally arrested and deported without proper procedure, the public has been eager to see someone take a stand.
