A federal judge in Ohio has blocked the state from requiring people to provide documentary proof of US citizenship when registering to vote through the Bureau of Motor Vehicles. US District Judge Solomon Oliver Jr. determined that Ohio’s requirements conflict with the National Voter Registration Act.

The decision has already ignited an angry debate online, especially with the November midterms fast approaching. While supporters see the decision as removing an unnecessary obstacle for eligible voters, critics are accusing the court of undermining efforts to strengthen election security.

According to a 54-page opinion, the reason District Judge Solomon Oliver Jr. blocking the law, he writes, “This case asks whether the National Voter Registration Act (“NVRA” or the “Act”) preempts Ohio’s motor voter law because the Ohio law only requires the BMV registrar or deputy registrar to offer driver’s license applicants the opportunity to register to vote if the applicant “presents proof of United States citizenship,” or has previously done so...

Such a requirement, Plaintiffs contend, is preempted by the National Voter Registration Act because it exceeds “the minimum amount of information necessary” to assess an applicant’s eligibility to vote. (Mot. at PageID 362, ECF No. 29) (quoting 52 U.S.C. § 20504(c)(2)(B)).“

The ruling does not eliminate Ohio’s existing identification requirements at the polls. Residents are still required to present an acceptable form of photo identification when casting a regular ballot, meaning the decision specifically concerns what documentation can be demanded during the BMV registration process.

In a different X post by Ohio Governor Mike DeWine, he calls for an immediate appeal, saying, “If you don’t prove your citizenship status, which is required by law to receive a state ID or driver license in Ohio, the Ohio BMV should not ask if you want to register to vote. Period.

This is common sense to everyone except activist plaintiffs and a DC lawyer who want to uproot Ohio’s strong voter registration system. Appeal inbound.”

Comments and Reactions to Ohio’s Voter Registration Ruling

The ruling quickly triggered frustration and suspicion among commenters who believe stricter citizenship requirements are necessary. One commenter wrote, “Here we go again back to the Supreme Court So everywhere this is happening is where the cheat is being planned ? I would assume nothing else.”

Another commenter called for “acitivist” judges to face consequences, writing, “Any activist jurist should be impeached and disbarred. Their job is to enforce the US Constitution as it was written, not how they think it should have been written.“

As the ruling continues to gather the attention of more people online, the different reactions show just how intense things have become concerning the voter-registration process ahead of November’s elections.
