A North Carolina delivery driver says he is looking for legal advice after receiving misdemeanor citations for resisting, delaying, or obstructing an officer and driving without a license following a police encounter during one of his deliveries. The man argues the charges do not make sense because officers eventually confirmed he had a valid driver’s license before issuing the citations.

The story was shared on Reddit’s r/legaladvice subreddit, where the driver described the encounter in detail while asking whether the charges could be dismissed. The post quickly drew hundreds of comments from users offering legal advice and debating whether the citations would hold up in court.

According to the North Carolina driver, a police officer pulled into a customer’s driveway behind his marked company delivery van while he was carrying packages to the home. He said the officer approached him with a hand on his firearm and demanded identification. The officer allegedly explained that multiple people had reported someone matching his description for possible animal abuse.

The driver said he told the officer he did not have his wallet on him because he keeps it locked inside the delivery van while working, but said he was willing to provide his identification. He added that he had encountered several loose dogs during his route that day, which he described as a common part of the job, although he was never charged with animal abuse.

During the encounter, the homeowner reportedly came outside, and the driver admitted he referred to the first officer as “this clown” while speaking to the customer. A second officer later arrived and, according to the post, allowed him to retrieve his driver’s license from the van. The driver also contacted his employer, who spoke with the officers.

After about 30 minutes, the first officer returned the driver’s license and issued citations for resisting, delaying, or obstructing an investigation, along with driving without a license. The driver disputed both citations, arguing that officers had verified his valid license before writing the ticket. He said he has since contacted several attorneys but cannot afford legal representation.

North Carolina Case Sparks Reddit Debate

Many Reddit users believed the driver’s account raised enough legal questions that the citations should be challenged in court rather than simply paid. Several were especially confused by the driving-without-a-license charge, pointing out that the North Carolina officer had already confirmed the driver possessed a valid license. “A whole lotta nonsense. But since you were cited, you need to go to court to obtain a dismissal,” one user wrote.

The overwhelming advice was for the North Carolina resident to find a lawyer despite the cost. Many argued the resisting charge was the more serious issue because it is a criminal offense, with several saying he “can’t afford not to hire a lawyer.” Others suggested seeking a public defender, legal aid organization, or pro bono assistance if private counsel was out of reach.

Some commenters also recommended requesting the officers’ body camera footage and using the discovery process to obtain evidence related to the stop. Others believed the customer’s testimony, the driver’s employer, and the second responding officer could all become important witnesses if the case proceeds.

Not everyone fully agreed with the driver’s account. Some questioned why he initially told the officer he did not have his identification instead of immediately explaining it was locked inside the delivery van, while others believed the encounter escalated unnecessarily and speculated the resisting citation may have been influenced by the driver’s remark calling the North Carolina officer a “clown.”

For now, the delivery may be over, but the real stop appears to be happening in court.
