Marriage is hard even under the best of circumstances. However, one North Carolina couple’s divorce made national news after the jilted wife decided to file a lawsuit against her now ex-husband’s mistress, and was awarded more than $1 million in the process. It might sound like a storyline straight out of a daytime soap opera. However, that’s not the case. The drama really happened, and it had some very real consequences.
The drama started when TikTok influencer Brenay Kennard, who has more than 3 million online followers, was accused of seducing her manager, Tim Montague. At the time, Tim was married to his wife, Akria Montague, with whom he shares children.
Brenay allegedly started a romantic relationship with Tim while he was still married. Akria claims that the relationship ruined her marriage to Tim, leaving her as a solo parent, causing her physical and emotional pain, and hurting their children in the process. Because Brenay knowingly interfered in the couple’s marriage, Akria had the legal right to sue due to North Carolina’s alienation of affection law, per NY Post.

Akria did file a suit against Brenay, and after a trial the jury agreed with her. Akria was awarded $1.5 million under the alienation of affection law. Brenay was also ordered to pay an additional $250,000 for the legal consequences of having a sexual relationships with someone else’s spouse.
When the judgment was announced, the courtroom erupted in cheers from Akria’s side. Meanwhile, Brenay was left with a devastating legal and financial blow. However, she does have Tim, whom she married after he officially divorced Akria.
Of course, the drama has become a huge topic of conversation on social media. After the verdict was revealed, many took to TikTok to share their thoughts on the controversial topic. Some were confused about why Brenay sued her ex-husband’s mistress and not her former husband. However, it seems that the divorce was all she could do on that part.
“Yall are missing the point. The LAW allows someone to sue a THIRD PARTY…..she couldn’t sue her husband, she COULD sue the mistress, so she did,” one person explained. “But it wasn’t just her that broke up the marriage. the husband obviously doesn’t want to be with his wife anymore. so this doesn’t really make any sense. how is this a law? it takes two people to break up a marriage,” said another. “Wow this is ridiculous,” a third comment read. “Adultery is too expensive,” a fourth person quipped.
This is definitely a touchy subject, and everyone has their own thoughts about the case. However, it will likely make people in North Carolina, and around the country, think before being unfaithful to their spouse.
