Virginia Gov. Abigail Spanberger faced criticism after questioning the timing of state Sen. L. Louise Lucas’ federal indictment. Lucas faces drug-trafficking allegations, but Spanberger warned that bringing charges near an election undermined public trust. Her response drew objections from critics who questioned why election timing should matter in a criminal case.

I have read the charging document alleging a series of criminal acts by a member of the Virginia Senate. In our American system of justice, people are presumed innocent until proven guilty, and that is true for Senator L. Louise Lucas. She and her family deserve the opportunity…

In her statement, the governor said she had reviewed the charging document outlining alleged criminal acts by Lucas. She emphasized that Americans are “presumed innocent until proven guilty,” regardless of the accusations against them. She also maintained that Lucas and her family deserved the opportunity to defend themselves and respond to the allegations.

However, her concerns extended beyond the senator’s right to defend herself. She argued that the indictment violated the Justice Department’s previously longstanding practice of avoiding significant legal action near elections. That included indictments and major investigative steps. She warned that the timing “further erodes the trust” Americans deserve to have in the department.

On X, users challenged Spanberger’s focus on election timing, raising questions about the allegations and Lucas’ absence from the ballot.

“Timing? She’s accused of distributing drugs and you’re saying the ‘timing’ is a problem?” one user wrote. Another questioned the election connection, asking, “Where is she on the ballot, Abigail?”

Others focused on the investigation’s origins and whether election season should affect criminal proceedings. “The investigation started under Biden,” one response stated. Another argued, “We don’t pause federal investigations because a politician’s party has an election coming up.”

However, some responses reflected different concerns. “Agreed – innocent until proven guilty,” one user wrote. Another emphasized the political context, stating, “Fair trials, not election season theatrics.”

Lucas still faces the allegations outlined in the indictment. The court proceedings will determine whether prosecutors can prove the charges.
