In California, a Person Has Sleep Problems Because of a Home Depot: ‘Interfering With the Comfortable Enjoyment of Life or Property Is a Nuisance’

Sleep is not only a valid aspect of everyone’s health and a necessity, but also a luxury to rest fully. Every living being needs adequate sleep to have enough energy in their daily lives, but people have more and more difficulty having restful sleep because of stress. Add to all this the fact that something external prevents you from sleeping. That’s what this person is experiencing in California, who lives near a Home Depot where an alarm was recently installed to scare away homeless people. That’s why OP decided to ask for advice on Reddit to put an end to this desperate situation after so many sleepless nights.

The Redditor Revolutionary-Pop369 shared on r/legaladvice this problem that bothers them every night. OP explains that he lives in California in a house very close to a Home Depot, but the store recently installed an alarm to prevent the homeless from sleeping there. The problem is that the alarm consistently goes off every so often, and because of the proximity to OP’s house and the materials in the house, anyone can hear the alarm perfectly. Sometimes, even the alarm sounds during part of the day, and now that it is almost summer, OP leaves their window open, and it sounds even louder. OP already tried to talk to the store manager, and although the problem stopped for a few days, it’s active again, so he asked the other Redditors for advice. Fortunately, other users were quick to leave their opinions and useful advice for this particular case:

“Anything which is injurious to health…or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property” is a nuisance.
Likely, there is legal action to pursue here, and you would probably want to seek legal counsel from a local lawyer practicing real estate/property law if your attempts at resolving via contacting corporate go nowhere. Keep documentation of any interactions/discussions between you and Home Depot.

Still, OP plans to contact the regional manager or call corporate to see if they can help with this problem. Revolutionary-Pop369 also wants to contact the city council or a lawyer to ask for a Cease and Desist letter to end their long, miserable nights without rest.
