‘Keep Your Hands Off Our Ballots’: California Gov. Gavin Newsom Sends Lawyers Into Election Fight With Trump

That was a bold move

With the November midterm elections approaching, California Governor Gavin Newsom has a message for Donald Trump: keep your hands off the state’s ballots. In a post on X, Newsom announced that he was sending election lawyers into key battleground districts and emphasized that illegally seizing ballots is now a felony under California law.

Newsom framed the move as an effort to protect California voters, but not everyone interpreted it that way. Critics flooded the replies with accusations of political theater, questions about election fraud, and suggestions that Newsom was more concerned about scrutiny than safeguarding the vote.

A warning to Donald Trump:

I’m deploying election lawyers to key battleground districts in California to protect every vote.

And I just made it a FELONY to illegally seize ballots.

— Gavin Newsom (@GavinNewsom) October 29, 2026

Newsom’s warning comes in the middle of an ongoing election fight between California and the Trump administration. The Justice Department has tried to stop the state from processing ballots from roughly 20,000 voters it alleges could be noncitizens. Courts have rejected those efforts so far, but the DOJ isn’t backing down and is appealing the latest ruling.

Newsom’s team isn’t sending only a handful of lawyers, either. His campaign says 134 election attorneys will be deployed alongside hundreds of trained poll observers and hotline operators, with teams focused on several competitive congressional districts. The effort is intended to monitor vote counting and respond to potential federal intervention.

Newsom’s warning about felony charges wasn’t just rhetoric. He signed AB 282 in September, making it a felony to illegally seize ballots, election records, or certified voting technology before election results are certified. The law also creates tougher penalties for someone in authority who directs another person to carry out such a seizure.

The law followed a major fight over Riverside County Sheriff Chad Bianco’s seizure of roughly 650,000 ballots from the 2025 Proposition 50 election as part of an investigation into suspected election fraud. The California Supreme Court ruled in September that the seizure was unlawful and ordered election officials to return the ballots. The court made clear that election officials can still investigate suspected misconduct, but voted ballots must remain in their custody under state law.

That doesn’t mean officials can’t investigate suspected election misconduct. The California Supreme Court made that distinction clear, saying there are already ways to investigate potential problems without taking voted ballots out of the hands of election officials. The new felony penalties deal with illegal ballot seizures, not legitimate election investigations.

The fight between California and the Trump administration isn’t ending there. The Justice Department says its efforts are about stopping potentially ineligible voters from participating in the election. California officials argue the federal government could interfere with lawful vote counting. With Election Day just days away, that fight is now playing out in court and online.

Newsom’s Warning Sparks Backlash

Newsom’s warning did little to convince some of the people responding to his post, many of whom immediately questioned what prompted such a forceful announcement. “This post is what panic looks like,” wrote one user.

Other users were less interested in the warning to Trump and more concerned with Newsom taking credit for the legislation, another user writing, “You didn’t “make” anything a felony. You signed a bill the legislature handed you so you could pretend you’re stopping Trump. Bianco’s seizure already got ruled illegal under the old law. This is just theater to keep people from looking at the ballots. Your state statute doesn’t stop the DOJ. Try harder.“

The commenter is correct that the California Supreme Court ruled Bianco’s ballot seizure unlawful under the law already in place. AB 282 went further by creating specific felony penalties for certain illegal seizures of ballots and other election materials before results are certified.

The discussion eventually shifted to broader accusations about California’s elections, with some commenters claiming the state failed to address potential voting by noncitizens.

The online argument is unlikely to be the last fight over California’s ballots before Election Day. The Trump administration is appealing its latest court loss over the roughly 20,000 challenged ballots, while Newsom’s team is preparing attorneys and observers for several closely watched congressional districts. With votes already being processed, the next round of this dispute may play out in court rather than on X.
