A New Jersey Republican assemblywoman, Dawn Fantasia, grabbed attention online after she tore into her Democratic colleagues during a floor speech about a set of immigration bills. Fantasia argued the legislation breaks the Constitution and will leave taxpayers with the bill for doomed lawsuits. Her speech made the rounds on social media. Governor Mikie Sherrill signed them into law that March. The laws put new limits on local police working with U.S. Immigration and Customs Enforcement, stop police from sharing immigration data without a warrant, and ban officers from hiding their identities while on duty, a move partly aimed at federal agents who cover their faces during immigration raids.
In the video, Fantasia goes into the constitutional issues behind the bills. She calls out the Supremacy Clause, reminding everyone that federal law beats state law when it comes to federal authority. “For the love of God and all that is good. Can you differentiate between the fact that we don’t make laws that control the federal government?” she tells the room, pressing her mostly lawyer colleagues on what she sees as a basic legal point.
Her objection isn’t about ideology, she explains. It’s about practicalities, about wasting money, and repeating the same mistakes New Jersey has made before: passing laws that end up in court. Fantasia says she knows she is not likely to change many minds in a statehouse run by Democrats. Still, she insists that everyone, regardless of party, should agree on the logic of not passing laws that are just asking for a constitutional fight.
She reminds her colleagues that states can’t regulate or mess with federal agents, and says it’s obvious the real target here is ICE. But, she argues, states aren’t allowed to touch that. The New Jersey Republican brings up examples from other states, where similar laws have already been shot down, and frames these new bills as more of the same predictably doomed moves.
