A Texas couple arrived home to find a sergeant inside their garage. They accused him of trespassing and violating their Fourth Amendment rights, all while the cop was caught saying that the garage was “open to the public” due to the open door.
TikToker Masha, whose username is masha_andthetruth, shared multiple clips of the interaction with the officer, whom she identified as Sgt. David Weis. The clip attached above garnered 628,700 views, 27,500 likes, and more than 3,600 comments. With four parts total, Masha amassed over two million views.
An initial clip showed the Texas couple arriving at their garage to find Sgt. Weis in there already. Once the two parties saw each other, the cop immediately explained that he was trying to catch a break from the heat by using the couple’s fan located inside the garage.
Masha captioned the clip, “Doesn’t the Constitution protect us from [expletive] like this?”
While Masha’s husband initially laughed at the situation and at the cop’s heat excuse, the woman was not having any of it. Both of them eventually questioned why he would enter their garage in the first place.
The sergeant answered, “I just told you. I was standing by the fans.”
‘Open To The Public’
Masha told her that there was a “no trespass sign” in the garage. The cop responded, “Ma’am, I’m a police officer,” and said that he was on official Montgomery County duty.
The follow-up clip, the one attached above, then showed the continued back-and-forth. Masha’s husband continued to tell the cop he wasn’t allowed to enter their garage. The sergeant, meanwhile, gave another explanation, saying, “It’s open to the public.” The Texas couple disagreed and told him he needed a warrant.
In another clip, Sgt. Weis is finally shown leaving the property, apologizing for potentially offending them.
Reactions
The video sparked multiple reactions, which vary heavily depending on the video. Some viewers were critical of the cop’s behavior. One said, “He’s illegally entering your home.” Another one commented, “The fact that he said it’s open to the public is laughable.”
Others, however, were fully in support of the sergeant. One wrote, “You guys are horrible. He was just cooling off for a second.” Another one asked, “We’re all on the cops’ side, right?” A third one added, “Why not get him a water or Gatorade? Maybe get him a chair? Thank you, Mr. Officer, for your services.”
It is unclear what official duty the sergeant was carrying out at Masha’s home.
