‘They Do Not Speak for Me’: Michigan Residents Furious as DTE and Consumers Energy Sue to Block Voters’ Decision

The gloves are off

Michigan voters may have thought they’d settled the score with the state’s utility giants on Election Day, but DTE Energy and Consumers Energy aren’t going down without a fight. Just days after residents overwhelmingly backed new restrictions on utility companies’ political donations, the two companies have filed a federal lawsuit challenging the decision. Unsurprisingly, the move hasn’t gone down particularly well with some Michigan residents.

According to Michigan Public, the two utility companies filed their lawsuit on Thursday, November 5, just two days after Proposal 2 received support from approximately 81% of Michigan voters. The companies argue that the restrictions violate their First Amendment rights, unfairly targeting utility workers and their families while allowing other groups to continue making political donations. They’re now asking a federal court to block the restrictions from taking effect.

Interestingly, the lawsuit hasn’t come as much of a surprise to those who campaigned for Proposal 2. Speaking to the outlet, campaign manager Maura Cowley suggested that the utility companies had been preparing to take legal action long before voters headed to the polls. Despite the challenge, Cowley remains confident that the measure will hold up in court, stressing that Michigan residents have already made their feelings clear with an overwhelming vote in its favor.

For those unfamiliar, Proposal 2 aims to reduce the influence of big-money donors in Michigan politics by restricting political contributions from major utility companies and certain government contractors. Supporters believe the measure will give ordinary residents a stronger voice in decisions affecting their communities, particularly when it comes to issues like electricity bills and energy policy. However, with DTE and Consumers Energy now challenging the restrictions in court, Michigan residents face an uncertain wait to see whether the changes they voted for will actually take effect.

Over on Reddit, Michigan residents haven’t exactly welcomed the lawsuit with open arms. One commenter took issue with the companies’ claims about representing their employees, declaring, “They do not speak for me with their $$.” Another questioned the companies’ motives, writing, “Them suing is surely a really good indicator this is needed.” Meanwhile, someone else brought household finances into the debate, sarcastically remarking, “Glad our utility bills are funding a lawsuit against a mandate of the people.”

Interestingly, the lawsuit also names Ayesha Lancaster, the 86-year-old mother of DTE treasurer Case Lancaster, as a plaintiff. According to Local 4, the companies argue that Proposal 2 would restrict her ability to make political donations despite having no involvement in the utility business. That concern was echoed by one Reddit user, who argued, “The angle is that family members of certain employees are prohibited from donating as well. Seems pretty clearly unconstitutional, although some parts of the amendment should hold up.”

Others were less sympathetic. One commenter suggested taking the debate even further, writing, “Wait until the next proposal is Public Ownership.” Another expressed concerns about the potential legal outcome, warning, “They unfortunately may win because of the Citizens United ruling by SCOTUS in 2010.”

For Michigan residents, the battle over Proposal 2 is far from over. While voters made their feelings clear at the ballot box, DTE Energy and Consumers Energy are now hoping the courts will have the final say. With political influence and the power of utility giants once again under the spotlight, it seems this fight is far from done and dusted.
