Her legal team argues that attempts to deliver the lawsuit were invalid because the documents were never sent to her personal address. Lawyers Challenge How Ellen DeGeneres’s 2023 Crash Lawsuit Was Served
Court documents obtained by PEOPLE show that DeGeneres’ lawyers filed a motion to quash service of summons after the plaintiff claimed three attempts were made to deliver documents on January 5, 6, and 7, 2026. The legal team contends the delivery was made at NKSFB, LLC, a business management firm, rather than DeGeneres’ personal residence.
A declaration from Neuman + Associates partner Harley J. Neuman stated: “Neuman + Associates is not Ms. DeGeneres’ dwelling house, usual place of abode, or usual place of business,” and that DeGeneres “was not at Neuman + Associates at the time of the drop off.”
Regarding a December 23, 2025, drop-off at the firm, Neuman added:
“There was no verbal interaction with the process server that I am aware of. The process server did not inform anyone of the contents of the documents that I am aware of. Nobody signed any acknowledgement of receipt of the documents that I am aware of.”
The documents also highlighted the role of the building’s security, stating, “It should be reasonably apparent to anyone, especially a process server, that a security guard at a 20-story building is not ‘in charge’ of a business on the fifth floor of that building.”
Plaintiff Alleges Negligence and Seeks Damages
The plaintiff claims that DeGeneres’ alleged actions caused both property damage and personal injuries. She asserts that DeGeneres “entered an intersection without stopping at a stop sign,” colliding with her Tesla.
In her filing, she lists wage loss, property damage, medical expenses, loss of earning capacity, emotional distress, and loss of enjoyment of life as damages resulting from the alleged crash. The lawsuit seeks unspecified compensatory damages, with a court date set for April 30, 2026.
As the legal battle unfolds, the question of whether the lawsuit was properly served could play a key role in how the case proceeds, with both sides preparing for the April court date.
